The Polar Express 10th Anniversary Sweepstakes

COMPLETE OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VALID IN THE FORTY-EIGHT (48) CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY. MANY WILL ENTER, FEW WILL WIN.

  1. HOW TO ENTER: The Polar Express 10th Anniversary Sweepstakes (“Sweepstakes”) begins at 12:01 p.m. (Pacific Time [“PT”]) on October 1, 2014 and ends at 11:59 p.m. PT on November 9, 2014 (“Sweepstakes Period”). To enter, during the Sweepstakes Period visit www.thepolarexpresscontest.com and then click on the link or tab for the Sweepstakes. Then complete the online entry form in its entirety by providing all required information and submit it in accordance with the on-screen directions during the Sweepstakes Period. All required information must be provided or your entry will be void and ineligible. There is a limit of one (1) entry per person and per email address per day. All entries must be received by 11:59 p.m. PT on November 9, 2014. Any use of automated, robotic, macro, programmed or similar quick-entry programs is prohibited. Attempts to exceed the maximum number of entries permitted, or to use more than one (1) email address, may result in disqualification. Sponsor (as defined below) will not correspond regarding receipt of entries. All entries submitted become the sole property of Sponsor and will not be returned.

  2. ELIGIBILITY: To enter the Sweepstakes, you must, at the time of entry, be a lawful, permanent resident of the forty-eight (48) contiguous United States or the District of Columbia, be thirteen (13) years of age or older, and be physically located in the forty-eight (48) contiguous United States or the District of Columbia. Sweepstakes is void in all areas outside of the forty-eight (48) contiguous United States and District of Columbia, and where prohibited by law. The Sweepstakes and any websites, web pages and advertisements relating thereto are intended for viewing only within the United States. Entries received from persons residing outside of the eligible geographic areas, or where restricted or prohibited by law, will be disqualified. Employees, officers, directors, representatives, independent contractors and agents of RPMC (“Sponsor”), Warner Bros. Consumer Products (“WBCP”), Rail Events, Inc., Lionel.com LLC, Houghton Mifflin Harcourt, PaperStyle.com, Inc., Chris Van Allsburg, The Thomas Kinkade Company and their advertising and promotion agencies, and their respective parent companies, affiliates, franchisees, subsidiaries, promotion partners and agencies (collectively, the “Sweepstakes Entities”), and their immediate families (parents, siblings, children and spouses of each, regardless of where they live) and members of the households (whether related or not) of such employees, officers and directors, are ineligible to participate in this Sweepstakes.

  3. DRAWING AND NOTIFICATION OF PRIZE WINNERS: The Sponsor, whose decisions are final and binding in all matters relating to this Sweepstakes, will conduct a random drawing on or about November 10, 2014 to select one (1) Grand Prize winner, fifteen (15) First Prize winners and fifteen (15) Second Prize winners. Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes Period. The Grand Prize winner will be notified by telephone or email. First Prize and Second Prize winners will be notified by prize delivery, using the contact information provided at the time of entry. If a prize or the prize notification is returned as unclaimed or undeliverable, such prize winner may be disqualified and an alternate winner may be selected via a random drawing. All notification requirements, as well as other requirements within these Official Rules, will strictly be enforced.

  4. PRIZES:

    One (1) Grand Prize: The Grand Prize consists of: Round-trip coach class air transportation for the Grand Prize winner and three guests to Providence, Rhode Island from the major U.S. gateway airport nearest Grand Prize winner’s home; three (3) days/two (2) nights hotel accommodations ((quadruple occupancy for one (1) room only); four (4) tickets to the Polar Express Train Ride at the Blackstone Valley Railway; meet and greet with Chris Van Allsburg; breakfast for four (4) daily; dinner for four (4) on two nights; mid-size car rental for the duration of winner’s stay (designated licensed driver must be 25 years or older; excludes gas, tolls, parking, collision damage waiver, and insurance, and is subject to car rental terms and conditions). In addition to the trip for four, the Grand Prize winner will also receive a deluxe Lionel Polar Express Train Set (G-Gauge), an aurora gold framed 18” x 27” limited edition canvas Polar Express artwork by Thomas Kinkade Studios (signature numbered canvas with a Certificate of Authenticity); “The Polar Express” hard cover book autographed by Chris Van Allsburg, “The Polar Express” movie on DVD, and a coupon for a set of personalized holiday cards by PaperStyle.com. Approximate Retail Value (“ARV”) of the Grand Prize is $7,709.00. If the winner resides in Providence or within a one hundred (100) mile radius of Providence (“local resident”), in lieu of the round-trip coach air transportation, winner may receive round-trip limousine transportation for winner and his/her travel companions from winner’s residence to the hotel and/or Sponsor may, in its sole discretion, substitute another prize component. No compensation will be awarded in lieu of the difference in the ARV for the Grand Prize for a local resident and the ARV for the Grand Prize for a winner who is not a local resident. The actual value of the Grand Prize may vary depending upon the location of the Grand Prize winner’s residence, fares at the time of travel and the value of services rendered and products provided at the time of the event. Any difference between the actual value and ARV will not be awarded. Winner is responsible for transportation to and from the major U.S. gateway airport and his/her residence, including but not limited to any costs associated therewith. The winner of the Grand Prize and his/her travel companions must travel December 5 – December 7, 2014 or on such other dates specified by WBCP. If the potential Grand Prize winner cannot travel on such dates, then he/she may be disqualified and an alternate potential Grand Prize winner may be selected from among all eligible entries received via a random drawing, if time permits. All travel arrangements must be made by Sponsor at least twenty-one (21) days prior to travel, and winner and his/her travel companions must travel together on the same itinerary. Exact travel times and arrangements are subject to availability and blackout periods. The Contest Entities are not responsible for any cancellation with respect to travel, delays, diversions or substitutions, or any act or omission whatsoever with respect to the Grand Prize. The Grand Prize winner must comply with all hotel check-in requirements, including but not limited to providing a major credit card at check-in. All meals, taxes, gratuities, incidentals (including mini-bar and entertainment expenses), souvenirs, taxicab fares, phone charges, public ground transportation, and any other expenses not specifically identified in these Official Rules as included in the Grand Prize are the responsibility of the Grand Prize winner. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. If the Grand Prize winner or any travel companion of the Grand Prize winner is deemed a minor in his/her state of residence, then the parent/legal guardian of such minor must accompany the winner on the trip. Unless the winner is the parent or legal guardian of the travel companion, the travel companion must be at least eighteen (18) years of age or older as of the date of departure. While the Sponsor will make every effort to provide the “meet and greet” with Chris Van Allsburg, due to potential changes in his schedule, illness and/or other factors not within Sponsor’s control, Chris Van Allsburg's attendance at the scheduled event is SUBJECT TO AVAILABILITY. In the event that Chris Van Allsburg is unable to attend, all trip elements excluding Chris Van Allsburg's participation pertaining to the prize will still be offered.

    Fifteen (15) First Prizes: Each prize consists of a prize pack which includes: A deluxe Lionel Polar Express Train Set (G-Gauge), a Canvas 20” x 20” Gallery Wrap with Polar Express artwork by Thomas Kinkade Studios; “The Polar Express” hard cover book autographed by Chris Van Allsburg “The Polar Express” movie on DVD and a coupon for a set of personalized holiday cards by PaperStyle.com. The ARV of each First Prize is $403.00.

    Fifteen (15) Second Prizes: Each prize consists of a prize pack which includes: “The Polar Express” hard cover book autographed by Chris Van Allsburg and “The Polar Express” movie on DVD. The ARV of each Second Prize is $33.95.

    The approximate total value of all prizes is $14,263.25. Sponsor makes no representation or warranty that autographed prizes can be sold, bartered, or traded for at the stated values. The value of autographed prizes is subject to market conditions, which can fluctuate. All prizes are provided “as is” with no warranty or guarantee by Sponsor, either express or implied. Any and all warranties and/or guarantees for a prize (if any) are available exclusively from the manufacturer of the prize and are subject to such manufacturers’ terms therefore. Winner agrees to rely solely upon such manufacturer(s) for any such warranties and/or guarantees. No transfer, substitution or cash equivalent for prizes is allowed, except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason. All expenses not specifically identified in these Official Rules are the sole responsibility of each winner. Sponsor shall not be liable for failure to perform any of its obligations hereunder resulting directly or indirectly from or contributed to by any acts of God, acts of a participant, acts of civil or military authority, terrorism or terrorist threats, fire, strikes or other labor disputes, accidents, floods, epidemics, war, riot, delays in transportation, lack or inability to obtain materials, components, labor or fuel supplies, or other circumstances beyond the Sponsor’s reasonable control, whether similar or dissimilar to the foregoing. Please allow four (4) – six (6) weeks for the delivery of First and Second Prizes from the time such winners are selected. There is a limit of one (1) prize per person/family/household.

  5. RELEASES/TAXES: The Grand Prize winner will be required to execute and return an Affidavit of Eligibility, a Liability Release and a Publicity Release (except where prohibited) (the “Affidavit/Release”). Each travel companion is required to execute a Publicity/Liability Release in the form provided by Sponsor (except where prohibited by law). If a potential Grand Prize winner or a travel companion is deemed a minor in his/her state of residence, then the parent/legal guardian of such minor must sign any documents required herein on behalf of such minor and must accompany minor on the trip as well. . All Affidavit/Releases must be returned within the time indicated in the documents. If such documents are not returned within that time, then the potential winner will be disqualified, and an alternate potential winner will be selected from among all eligible entries received via a random drawing. All federal, state, local or other tax liabilities, including but not limited to income taxes or like amounts in connection with a winner’s award, acceptance or use of a prize arising from this Sweepstakes will be the sole responsibility of each winner. Each winner shall be solely responsible for the payment of any taxes due as a result of winning his/her prize.

  6. DISQUALIFICATION: If an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential winner will be disqualified, and an alternate potential winner will be selected from among all eligible entries received via a random drawing. If a prize or prize notification is returned as undeliverable, this will result in disqualification, and an alternate potential winner will be selected from among all eligible entries received via a random drawing.

  7. PRIVACY: Except where prohibited by law, participation in this Sweepstakes and/or acceptance of a prize constitutes permission for the Sweepstakes Entities to use the winner’s name, photograph, likeness, statement, biographical information, voice and address (city and state) on a worldwide basis and in all forms of media, in perpetuity and without further compensation or limitation in connection with this Sweepstakes. Entry in the Sweepstakes constitutes consent to the transfer of the personal information collected from the entrant to the Sponsor for the purposes of administering the Sweepstakes and for such other purposes to which entrant may consent as outlined herein or on the Sweepstakes website. All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with WBCP’s privacy policy, available at www.thepolarexpresscontest.com. More specifically, Sponsor may collect information that you provide to enter the Sweepstakes and will use personal information you provide to enter the Sweepstakes to actually conduct the Sweepstakes. WBCP may further use the personal information to send you information about WBCP’s products. WBCP will provide you with an opportunity to opt-out of receiving this information at any time after you first receive such information from WBCP. Sponsor may also provide the personal information you provide to enter this Sweepstakes to third party fulfillment companies so that such companies may process and deliver prizes to winners.

  8. SWEEPSTAKES CONDITIONS: By entering, each entrant agrees: (a) to be bound by these Official Rules and any other documents required by Sponsor herein and by the decisions of the Sponsor, and to waive any right to claim ambiguity in this Sweepstakes, the Official Rules or any other documents required by Sponsor herein, (b) to indemnify, defend and hold harmless the Sweepstakes Entities and Facebook, and each of their respective officers, directors, employees, shareholders, representatives and agents (collectively, the “Released Parties”) from and against any and all liability, claims, losses, damages, demands, causes of action, penalties and expenses arising out of or related to any statement, action or failure to act by entrant during or in connection with his/her participation herein and/or any breach or alleged breach of these Official Rules or of any other documents required by Sponsor and, (c) not to sue and to hereby irrevocably and unconditionally release, waive and forever discharge the Released Parties, from any and all liabilities, claims and demands of any kind or nature whatsoever, in law or equity, whether known or unknown, which entrant (or entrant’s successors-in-interest, heirs and/or agents) ever had, now have, or in the future may have against the Released Parties, including, but not limited to claims arising out of or related to personal injury (including death) and/or damage, theft, loss or any other harm resulting in whole or in part, directly or indirectly, from (i) participation in the Sweepstakes or any Sweepstakes related activity, (ii) the acceptance, possession, misuse or use of the prizes, (iii) the use of any of the rights granted herein (including, without limitation, the use and exploitation of the entrant’s name, address [city and state], biographical information, statements, voice, photograph and/or other likeness), (iv) any malfunction or other problem with the Sweepstakes website, (v) any error in the collection or retention of entry information, and (vi) any typographical or other error in the printing, offering or announcement of any prize.

  9. LIMITATIONS OF LIABILITY: Sweepstakes Entities are not responsible for lost, late, stolen, misdirected, undeliverable or incomplete online entries due to system errors or failures or faulty transmissions or other telecommunications malfunctions; and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system/human errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, cable connections, or satellite transmissions, computer online systems, servers or providers, computer equipment, or entries not received by Sponsor on account of technical problems or traffic congestion on the Internet or at a website, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate. The Sweepstakes Entities are also not responsible for any malfunction of the entire Sweepstakes website or error in the collection, processing or retention of entry information.

  10. TERMINATION/SUSPENSION/MODIFICATION OF SWEEPSTAKES: If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the Sweepstakes, the Sponsor reserves the right at its sole discretion to terminate, modify or suspend the Sweepstakes and to select the winner by conducting a random drawing from those eligible entries received up to the time of the termination/suspension. Sponsor may also disqualify or prohibit an entrant from participating in the Sweepstakes or winning a prize in this or any other promotion conducted by Sponsor if, at its sole discretion, it determines that said entrant has violated the Official Rules or has threatened or is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices (including the use of automated quick-entry programs), or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

  11. DISPUTES: This Sweepstakes is subject solely to the applicable federal, state and local laws of the United States; provided, however, that except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Federal or state courts located in Los Angeles, California; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
